Brains and Hammers: The Court Record, the FMBN Estate and What Was Never Handed Over

Brains and Hammers has delivered housing in Abuja, and has also been ordered by a court to refund a buyer who waited more than five years for two flats she had paid for in full. Both facts sit in the public record, and a prospective buyer needs to hold them together rather than pick one.

The documented delivery is real. On 23 June 2026 the Federal Ministry of Information and National Orientation announced the commissioning and handover of keys at Bungalow City, an estate along the Dei-Dei to Zuba Expressway in Abuja. The ministry's statement is specific: "The houses were built by Brains & Hammers Limited with funding provided by the Federal Mortgage Bank of Nigeria (FMBN) under a Public-Private Partnership (PPP) arrangement." Leadership reported on 31 August 2026 that FMBN funded the project in 2019, which puts roughly seven years between the financing and the handover.

The court record

On 26 September 2023, in suit FCT/HC/GAR/CV/27/2022, Hon. Justice Abubakar Hussaini Musa of the High Court of the Federal Capital Territory gave judgment in Zainab Brimah v Brains and Hammers Limited. The claimant had paid N29,114,034.00 for two two-bedroom Coventry flats at Brains and Hammers City, Life Camp, Abuja, house numbers F2519 and F2517, following indicative offer letters dated 20 December 2017 and provisional allocation letters dated 8 and 9 January 2018.

The court found the non-delivery to be a breach of contract and ordered the company to refund the N29,114,034.00 in full, to pay N5,000,000.00 in general damages, and to pay a further N10,000,000.00 described in the order as "punitive damages for the Defendant's deliberate failure and refusal to discharge its contractual obligation to the Claimant for over five (5) years after the Claimant had made full payment." Specific performance was declined, and one relief was refused on the technical ground that there is no category of damages known as "general and punitive damages". No appeal appears in the searchable record.

A second FCT High Court document, Motion No. FCT/HC/M/6132/2024, shows the firm on the other side of an enforcement fight. Mab Global Estate Ltd obtained leave on 5 March 2024 to register an arbitral award dated 22 September 2022 as a judgment of the court. The company filed a notice of appeal on 11 March 2024 and sought a stay; the creditor executed a writ on 25 March 2024 regardless. On 14 May 2024 Hon. Justice S. B. Belgore set aside the writ as wrongly issued and restrained further execution. That ruling is procedural. It decided nothing on the merits, and the document does not state the award amount or the subject of the underlying dispute.
