Bali Villa Scams: Fake Notaris, Land Certificate Fraud, Nominee Risks

The Scale of the Problem

Bali's rapid property boom has attracted legitimate developers and outright criminals. The combination of high foreign demand, complex ownership rules, and inconsistent enforcement creates fertile ground for fraud. The most common scams involve fake notaris documents, land certificate fraud, nominee arrangement failures, and developer fraud.

Fake Notaris Documents

A notaris/PPAT is licensed by the Ministry of Law and Human Rights under Law No. 2 of 2014. Scammers use complicit notaris creating false documents, forge notaris documents with fake stamps, or use notaris with revoked licenses.

Protect yourself: verify the notaris through the Ministry at https://www.kemenkumham.go.id, confirm they are a registered PPAT for the specific area, engage your own independent notaris, and verify registration directly with BPN after any transaction.

Land Certificate Fraud

Common forms include overlapping certificates for the same parcel, forged BPN certificates not in the database, and expired rights presented as valid. Not all Bali land is registered; unregistered land may have customary (hak adat) claims.

Protect yourself: verify certificates directly with BPN at https://www.atrbpn.go.id, insist on seeing originals, commission an independent survey (pengukuran ulang), check for annotations and encumbrances, and engage a separate law firm for title searches.

Nominee Arrangement Failures

Despite being illegal under Article 26(2) of the UUPA, nominees remain widespread. They fail when the nominee sells without consent, dies (heirs claim the property), has creditors seize it, demands more money, or the relationship breaks down. Indonesian courts consistently rule these void. Do not use nominees. Use Hak Pakai, PT PMA, or leasehold instead.

Developer Fraud

Developers collect deposits then fail to complete construction due to insufficient funding, fund diversion, permit problems, or disappearance. Verify company registration at https://ahu.go.id, check construction permits with local DPMPTSP, visit completed projects, use milestone payments, and consider escrow.

General Protection

Use independent legal representation. Verify everything with BPN and government sources directly. Be suspicious of any pressure tactics.
