Oman Real Estate Scams: What Foreign Buyers Need to Know

Oman is not a high-fraud property market by global standards. Its legal framework is relatively clear, its courts function, and its registry system is centrally managed. But foreign buyers are targeted with specific patterns that exploit gaps in their knowledge of local law. The most damaging scenarios are not random; they follow predictable scripts. Knowing them in advance is the most effective protection.

The Most Expensive Mistake: Buying Outside an ITC

The single most common structural error made by foreign buyers in Oman is purchasing a property outside an Integrated Tourism Complex in the belief that they are getting freehold title.

Foreign nationals cannot hold freehold title to land or property outside ITCs in Oman. Royal Decree No. 29/2018 explicitly prohibits non-Omani ownership in most areas outside designated zones. A signed purchase contract for a non-ITC property does not give a foreign buyer legal ownership. If the transaction is not registrable at MOHUP because the buyer is not eligible, the title cannot transfer.

This situation arises in several ways:

- A seller or broker presents a villa or apartment in a non-ITC residential area as "available to all nationalities" without checking the legal position.

- A buyer is told that ownership will be held through an Omani nominee, with a private side agreement giving the foreigner the "real" beneficial interest. This is unenforceable. If the Omani name-holder sells the property, defaults on a debt that leads to seizure, or dies, the foreign buyer has no legal standing to recover the asset.

- The development is described as an ITC but has not received ITC designation from the Ministry of Heritage and Tourism. Project marketing materials and a master-plan brochure are not the same as an official ITC licence.

The fix is straightforward: before paying any amount, confirm that the project is on the official list of licensed ITCs, and check with MOHUP that the specific plot is within that boundary.

Reservation Deposit Fraud

The most frequently encountered fraud targeting foreign buyers in Oman is the fake reservation deposit. The pattern is consistent: a polished listing appears online, via social media, WhatsApp, or classified property portals, showing an attractive property at a competitive price. The seller or "agent" creates urgency by claiming other buyers are interested or that a price increase is imminent. The buyer is asked to transfer a relatively small amount, typically OMR 1,000 to OMR 5,000, to a personal bank account to hold the property.

Once the transfer is made, the seller either vanishes or continues to request additional payments under invented justifications such as ministry processing fees, title transfer charges, or developer approvals. Recovery is difficult even when reported to the Royal Oman Police, because the money has typically been moved and the fraudster's identity may be falsified.

The protection rule is absolute: no payment of any kind goes to any personal or business account until:

1. The seller's identity has been independently verified against the Mulkhiya (title deed) through MOHUP's registry.

2. A formal sale and purchase agreement has been reviewed by an Omani-licensed lawyer.

3. All payments are made to the escrow account (for off-plan) or directly through the closing process to a verified account with formal bank documentation.

Any agent or seller who resists providing registry-backed ownership proof before accepting money should be disqualified from the transaction.

Off-Plan Payment Diversion

Oman's off-plan escrow system under Royal Decree No. 30/2018 is one of the more robust protections for buyers in the ITC market. Developers are required to open a project-specific escrow account at a licensed Omani bank. All buyer payments must be deposited into that account. Withdrawals are permitted only for construction costs verified by the competent authority. This mirrors the Dubai model and is legally enforceable.

The scam variant that operates around this system is payment diversion: a legitimate project exists, the developer is real, but the payment instructions provided to the buyer direct funds to a general company account, a personal account, or an account at a different institution unrelated to the registered escrow. This can happen through compromised email (a fraudster intercepting developer communications and substituting account details) or through unscrupulous intermediaries who collect funds and fail to pass them to the correct escrow.

To avoid this:

- Obtain the escrow account details directly from the developer in writing, including the bank name, branch, and account reference specific to the project.

- Confirm those details by calling the bank directly before making the first payment.

- Never transfer staged payments based solely on an invoice or email that arrives close to a payment deadline without re-verifying the account details.

Misrepresented Residency Benefits

Oman's property-linked residency rules are a legitimate and well-documented benefit of ITC ownership. Buyers who invest OMR 100,000 or more in an ITC property qualify for a 5-year renewable residency, and those investing OMR 200,000 or more qualify for a 10-year Golden Residency, including family members.

Misrepresentation occurs in two directions. Some sellers overstate the residency benefit, implying permanence or a pathway to citizenship that does not exist. The residency is renewable but requires continued property ownership; it does not lead to Omani citizenship. Other sellers falsely claim residency eligibility for properties that are not within a qualifying ITC, or for investment amounts below the applicable threshold.
