When the Government Wants Your Land: Lessons From the Lagos-Calabar Coastal Highway

On 10 August 2026, President Bola Tinubu, represented by Lagos State Governor Babajide Sanwo-Olu, told a stakeholders' meeting that about 147 structures in Lagos will be affected by the service lane of the Lagos-Calabar Coastal Highway. Of those, only five are earmarked for full demolition, according to reports by Daily Post and other Nigerian outlets. The remaining 142 would face what officials called minimal impact. The President said affected owners would be compensated where applicable and asked them to be patient.

The number matters less than the principle behind it. A government can lawfully take private land for a public project, and no title document, however genuine, fully protects you from that. For diaspora buyers who assume a Certificate of Occupancy is the last word, this is one of the most important things to understand about Nigerian property.

The government's power to take land

Under the Land Use Act of 1978, all land in a state is vested in the governor, who holds it in trust for the people. What a buyer acquires is a right of occupancy, usually evidenced by a Certificate of Occupancy (C of O, the main land title document). That right is strong, but it is not absolute. The same law lets the government revoke a right of occupancy for "overriding public interest," which includes building roads, rail lines, and other public infrastructure.
