A 3 to 24 month installment plan shifts construction risk from the developer to the buyer. - Buyer's right to terminate and recover. What percentage of payments is refundable if delivery slips beyond a stated grace period?
- Title transfer trigger. Is title transferred at handover, at final payment, or at some later date? In Lekki, many developers hold title until the entire estate is sold, which leaves early buyers exposed if the developer fails.
- Defect liability period. Standard is 12 months from handover for structural and mechanical defects. Insist on at least this.
Diaspora-specific considerations
A diaspora buyer should never rely on the developer's recommended lawyer or surveyor. Appoint independent professionals: a SURCON-registered surveyor to verify the parcel and a separate lawyer enrolled with the Nigerian Bar Association to handle the documentary chain and the title perfection. Both should be paid by you, not by the developer or through the developer's network.
For remittances, use a licensed bank channel and request that the SWIFT advice carries the property purchase purpose code. This documentation is essential when you later want to repatriate sale proceeds or rental income through the CBN's investor and exporter window.
