Can Foreigners Own Property in the Philippines? The Condo 40% Rule Explained

A foreigner cannot own land in the Philippines. That rule comes straight from the 1987 Constitution, Article XII, Section 7, which reserves ownership of land for Filipino citizens and for corporations at least 60 percent owned by Filipinos. There is no residency workaround, no marriage loophole that puts land in your own name, and no long-term visa that changes it. What a foreigner can own outright is a condominium unit, and that single exception is where nearly all foreign property investment in the Philippines happens.

Why condos are the exception

The Condominium Act, Republic Act No. 4726 (enacted in 1966), creates a legal structure that separates the unit from the land beneath it. When you buy a condo, you own the unit as personal property and hold a proportionate interest in the condominium corporation that owns the land and common areas. Because you are not directly owning the land, the constitutional restriction does not block you.

That exception comes with a ceiling. Under RA 4726, foreign nationals collectively may own no more than 40 percent of the total units or floor area in any single condominium project. The remaining 60 percent must be held by Filipino citizens or Filipino-controlled entities. The cap is measured at the project level, not per buyer. Once a building hits 40 percent foreign ownership, it cannot sell another unit to a foreigner, and any transfer that would push it over the line is void. The Register of Deeds will not process a title transfer that breaches the cap.
