Andaman Boutique Residences Phuket: Foreign Quota, Sinking Fund, and What ฿38.4M Actually Buys
Andaman Boutique Residences Phuket: Foreign Quota, Sinking Fund, and What ฿38.4M Actually Buys
Andaman Boutique Residences is a 48-unit condominium project in Choeng Thale, Phuket, completed in June 2025 by Andaman Riviera Construction. The project sits roughly 700 metres from Bang Tao Beach and 21.6 kilometres from Phuket International Airport. Headline pricing runs from THB 38,448,000 to THB 78,775,400, with units sized between 218 and 302 square metres. For foreign buyers, the relevant questions are whether the foreign quota allows direct freehold ownership, what the sinking fund obligation actually costs, and what the project's Section 19 status under the Condominium Act 1979 means for long-term resale.
The Foreign Quota Math
Thailand's Condominium Act B.E. 2522 (1979), as amended, allows foreign nationals to hold freehold title to condominium units in their own name, subject to a building-wide cap of 49 percent of the aggregate unit floor area (Section 19 bis). Above 49 percent, foreign buyers must use one of three indirect structures: a 30-year leasehold, a Thai limited company majority-owned by Thai shareholders (closely monitored by the Department of Business Development to prevent nominee abuse), or a usufruct (sit-jam-rong) for life of the foreign holder.
For Andaman Boutique Residences, 49 of the 48 units have not been allocated to foreign quota (mathematically impossible since 49% of 48 units rounds to roughly 23.5 units). The publicly reported figure that 49 units fall inside foreign quota actually refers to the foreign-eligible aggregate floor area of 49 percent of total saleable area. Foreign buyers acquiring a unit in the foreign quota receive a Chanote (Nor Sor Sii Jor) condominium title deed registered in their own name at the Phuket Provincial Land Office.
Two practical implications. First, ask for written confirmation from the developer of the project's current foreign quota usage at the moment of your purchase. The quota fills on a first-registered basis, and a unit marketed as foreign-quota that ends up registered after the cap is hit reverts to a leasehold or company structure. Second, request a copy of the Condominium Juristic Person registration documents and the building's Title Deed from the Land Office. The Juristic Person manages the building's common-area assets and is the legal entity that signs your purchase.
The Sinking Fund Reality
Andaman Boutique Residences charges a sinking fund contribution of USD 15 per square metre of indoor area. For a 218 square metre unit, that is USD 3,270 at the closing. For a 302 square metre unit, USD 4,530.
The sinking fund (Section 18 of the Condominium Act) is a capital reserve used for major repairs and replacements of common-area infrastructure. It is paid once at the time of unit handover and is held by the Condominium Juristic Person. The annual operating fee (common area maintenance, or CAM) is a separate ongoing charge, typically billed monthly or quarterly.
Foreign buyers should ask three questions before paying the sinking fund. First, request the Juristic Person's audited financial statements for the most recent twelve months (the project completed in June 2025, so a partial-year statement should be available). Second, confirm the CAM rate per square metre per month and the historical inflation pattern on that rate at comparable Phuket developments. Third, confirm the meeting and voting rules at the Juristic Person's annual meeting, particularly the quorum requirements for extraordinary expenditures.
Bang Tao and Choeng Thale Context
Choeng Thale is the sub-district covering Bang Tao Beach, Laguna Phuket, and the corridor running north toward Layan. The area has become the centre of gravity for Phuket's high-end residential market over the last decade, displacing Patong as the focus of new foreign-buyer inventory. The Laguna Phuket integrated resort (now controlled by Banyan Tree Holdings) sits within walking distance of Andaman Boutique Residences.
The infrastructure story matters. The Phuket Light Rail project, approved in principle by the Cabinet in 2024, would run from the airport through Bang Tao to Phuket Town, materially compressing transit times. The project is in tender preparation as of mid-2026 and faces the usual Thai mega-project execution risk. Foreign buyers should treat the light rail as a free option, not a thesis.
The rental yield reality on Bang Tao boutique condos has been compressing as inventory grows. Headline gross yields of 6 to 8 percent on managed rental are achievable but require active management, attention to seasonality, and willingness to operate the unit hospitality-style. Net yields after management fees, sinking fund top-ups, CAM, and Thai withholding tax typically land at 4 to 5 percent.
The Tax and Repatriation Setup
Foreign buyers acquiring Thai condominiums must remit the purchase funds in foreign currency to a Thai-licensed bank and obtain a Foreign Exchange Transaction Form (FET, formerly Thor Tor 3) for each tranche above USD 50,000. The FET is the document that preserves your right to repatriate sale proceeds back offshore. Without the FET trail, the Bank of Thailand's foreign exchange controls under the Exchange Control Act B.E. 2485 will restrict your future outflow.
On rental income, non-resident foreign owners pay withholding tax at 15 percent on gross rental under Section 70 of the Revenue Code (Thai withholding for non-residents). Resident expats pay progressive Thai income tax. Property taxes under the Land and Buildings Tax Act B.E. 2562 (2019) apply at modest rates (0.02 to 0.10 percent for residential use) but are reassessed annually.
On capital gains, Thailand applies a Specific Business Tax of 3.3 percent on gross sale price for properties sold within five years of acquisition (under Section 91/2 of the Revenue Code), plus a progressive personal income tax on the gain itself. The five-year holding period reduces the SBT obligation materially.
Verifying Andaman Boutique Residences and the Developer
Andaman Riviera Construction is the listed developer. The standard verification sequence is:
Request the developer's Department of Business Development (DBD) registration certificate confirming corporate existence and current directors.
Request the Land Office search for the project's Chanote, confirming the developer's registered ownership of the land prior to construction.
Request the building permit (Or Yor Bor) issued by the Choeng Thale sub-district administration confirming the project complies with the Building Control Act B.E. 2522 (1979) and the Phuket-specific height and setback restrictions.
Request the Environmental Impact Assessment (EIA), which is required for condominium projects above 80 units or 4,000 square metres in EIA-sensitive areas.
Request the Condominium Juristic Person registration documents.

Bottom Line
Andaman Boutique Residences is a recently completed Bang Tao boutique condo with a price point that targets the mid-to-upper end of Phuket's foreign-quota inventory. The foreign quota math allows direct freehold for buyers who register within the 49 percent cap, the sinking fund is consistent with Phuket boutique norms, and the location is genuinely defensible. The serious work is the FET paperwork at the inflow, the Chanote registration in your name at the Phuket Land Office, the Juristic Person's financial position, and the developer's track record on prior projects. Bang Tao condo investing is a real asset class, but it lives on documentation and active management, not on brochure promises.
