Understanding the TAPU System

The TAPU (title deed) is the single most important document in Turkish property law. It is the definitive proof of ownership, issued and maintained by the General Directorate of Land Registry and Cadastre (Tapu ve Kadastro Genel Mudurlugu, TKGM) under the authority of the Land Registry Law No. 2644 and the Cadastre Law No. 3402.

Turkey operates a Torrens-style land registration system, meaning the state guarantees the accuracy of the register. If the TAPU says you own the property, you own the property, subject to very limited exceptions involving fraud or forgery. This is a stronger guarantee than many countries provide.

The guarantee attaches to registration, not to the contract, which creates a risk window. Between signing a sales contract and completing the transfer, a dishonest seller could in principle sell the same property again, and whoever registers first is the owner. Article 1009 of the Turkish Civil Code allows a preliminary annotation (tapu serhi) to be placed on the land register at the contract stage to protect the buyer's interest during that gap. Ask your lawyer to register one.

Types of TAPU

There are several TAPU formats foreign buyers need to understand.

Kat Mulkiyeti (Condominium Ownership) is the full ownership title for an individual unit within a building. It means the building has received its iskan (habitation permit) and the individual units have been registered separately. This is the type you want.

Kat Irtifaki (Construction Servitude) is a preliminary title issued during or shortly after construction, before the iskan is obtained. It provides ownership rights but is legally weaker than kat mulkiyeti. Some CBI applications have been complicated by properties stuck in kat irtifaki status.

Arsa Tapusu (Land Title) represents ownership of a plot of land, which may be residential or commercial zoned. Building on it requires a separate building permit process under the Zoning Law No. 3194.

Arazi Tapusu (Agricultural Land Title) represents ownership of agricultural land. Foreign nationals face significant restrictions on agricultural land under Article 35 of Law No. 2644.

The Military Clearance Requirement

Article 35 of Law No. 2644, as amended, requires that all property purchases by foreign nationals undergo a security check. The Land Registry office sends the property details to the Turkish Armed Forces General Staff to confirm the property does not fall within a military security zone or restricted area.

What Gets Checked

The property's geographic coordinates are verified against military zone maps maintained by the General Staff. The check covers proximity to military installations and bases, border security zones (especially along the Syrian, Iraqi, and Iranian borders), restricted airspace zones, naval security zones along certain coastlines, and strategic infrastructure areas.

Timeline

The official timeline is up to 30 business days. In practice, properties in Istanbul central districts clear in 1-2 weeks. Standard coastal properties in Antalya, Alanya, and Bodrum center clear in 2-4 weeks. Properties near borders or military areas take 4-8 weeks. Properties in eastern Turkey or certain Aegean islands may take longer.

Ankara and Izmir typically clear in one to two weeks. The clearance office issues no tracking or status updates, so you or your lawyer must check with the Land Registry Office periodically rather than waiting to be told.

Rejection

If military clearance is denied, the sale cannot proceed. The buyer has no right of appeal against the military's decision. The Land Registry will not process the TAPU transfer. Rejections are uncommon for mainstream urban and resort properties but do happen near sensitive areas.

Step-by-Step TAPU Registration Process

Documents Required

Gather the following before your Land Registry appointment: your passport (original and notarized Turkish translation), two biometric photos, your Turkish tax number (vergi numarasi), the preliminary sales contract, bank transfer receipts showing payment, the SPK appraisal report (mandatory for CBI applications and properties over certain thresholds), the seller's TAPU, the DASK compulsory earthquake insurance policy number, and a sworn translator if you do not speak Turkish.

Under the Compulsory Earthquake Insurance Law (Law No. 6305), all residential buildings in Turkey must have DASK insurance. The Land Registry will not process a transfer without it.

Two details on the documents trip buyers up. The SPK appraisal report must be dated within three months of the TAPU application, and the payment evidence has to show the funds came in through the Turkish banking system. The tax number itself is quick: the local tax office (vergi dairesi) issues it in about fifteen minutes on presentation of your passport alone.

At the Land Registry Office

Both buyer and seller must appear at the Tapu Mudurlugu for the property's district. If either party cannot attend, a power of attorney (vekaletname) is required, notarized and, for foreign-issued documents, apostilled and translated.

The Land Registry officer verifies all documents, checks the property record for encumbrances (mortgages, seizures, annotations), and confirms the tax declarations. The transfer tax (tapu harci) of 4% of the declared value must be paid, typically split 2% each between buyer and seller.

The 4 percent rate is set by the Fees Law (Law No. 492). In practice many sellers make the buyer paying the full 4 percent a condition of sale, so settle who pays what before you sign anything. A separate revolving fund fee (doner sermaye) of roughly 4,000 to 6,000 TL is also payable at the Land Registry Office at registration.

The Transfer

The officer records the transfer in the TAKBiS (Tapu ve Kadastro Bilgi Sistemi) electronic registry. You receive a new TAPU document with your name and a QR code linked to the TAKBiS database.

The appointment itself is short. The registrar verifies documents and identities, confirms the price and payment method, and reads the transfer details aloud in Turkish, which is why a sworn translator must be present if you do not speak the language. Both parties then sign. The whole session usually runs 30 to 60 minutes, and most offices issue the TAPU on the spot, though some provinces take a day or two to prepare the physical document.

For CBI applications, the three-year no-sale annotation is added at this stage.

After the Transfer

Register with the local municipality for property tax (emlak vergisi) under the Property Tax Law No. 1319. Rates are 0.1% for residential and 0.2% for commercial properties annually. In metropolitan municipalities (buyuksehir), rates are doubled to 0.2% and 0.4%.

Transfer utility accounts (water, electricity, natural gas) to your name.

Common Problems

Always request a current tapu kaydi (title record extract) before signing any contract. This shows all mortgages, seizures, and annotations. If a developer cannot produce an iskan belgesi, the building has not passed final inspection, which complicates resale and CBI applications. Use specific powers of attorney (ozel vekaletname) limited to the exact transaction rather than general powers. Never agree to declare a lower price on the TAPU to reduce transfer tax, as this is illegal and undermines CBI applications.

Do not confuse the notary with the Land Registry. In Turkey the notary (noter) handles powers of attorney, contract notarization, and document authentication, while only the Tapu Mudurlugu can transfer title. Signing a contract at a notary transfers nothing.

Watch the valuation as well. If the SPK appraisal comes in below the purchase price, a CBI applicant can fall short of the 400,000 US dollar threshold even though the price paid clears it.
