Portugal puts no nationality restrictions on who can buy property, so a foreign buyer here is choosing a developer on the same terms as a local one. That freedom cuts both ways. There is no foreign-ownership cap to hide behind and no special licensing tier that filters out weak builders for you. The brand and its delivery record are your due diligence. The rules behind that freedom
Article 1305 of the Portuguese Civil Code gives owners full freehold rights, and no nationality restriction attaches to residential real estate. What did change is the residency angle. Law No. 56/2023 (Mais Habitação) removed direct residential property from the Golden Visa programme, so buying an apartment no longer buys a route to residency; the surviving routes, including venture capital and cultural production funds, sit under Decree-Law 175/2024. For off-plan purchases, scrutinize the promissory contract (contrato-promessa de compra e venda). It should specify completion dates, the licensing status of the project, payment milestones tied to construction stages, and penalties for delay. Off-plan fraud, where a developer collects deposits for a project that never completes, is the single biggest risk in this segment.
Check the project's licensing with the local câmara municipal (town hall): the construction licence (alvará) and, for completed units, the habitation licence (licença de utilização). A building without the right permits cannot be legally sold or, sometimes, legally occupied.
Three documents belong in your hands before any deposit leaves them. The Caderneta Predial Urbana confirms the property's tax registration, the Certidão de Registo Predial confirms the title chain at the Conservatória do Registo Predial, and the Ficha Técnica da Habitação (Decree-Law 68/2004) confirms the construction specifications. The habitation licence is itself required under Article 62 of Decree-Law 555/99 before a private purchase deed can be registered. Ask as well where your deposit sits: some developers hold pre-construction money in a bank escrow facility under Bank of Portugal Aviso 1/2018 rather than in a developer-controlled account, which is the difference between protection and exposure.
Look at the developer's actual delivery history rather than its renderings.
