Orbita in Bali: What an 80-Year Leasehold Actually Means on Paper

Orbita sells villas on Bali's Bukit peninsula under a headline that reads "Security Leasehold 80 years (30+20+30)". Read the bracket. Eighty years is not the term granted at signing. It is a 30 year initial lease followed by two extension options, 20 years and then 30 more, and the extensions are contractual promises rather than rights already registered in the buyer's name. That distinction is the single most important thing a foreign buyer needs to understand before wiring a deposit on the Bukit, and it applies well beyond this one company.

The same Orbita page that advertises the 80 year figure also uses the term "Hak Guna Bangunan". Those are two different legal instruments. Mixing them in one sales page is common in Bali marketing, but the buyer carries the consequences of the difference.

What the lease structures actually are

Indonesian law gives foreigners a narrow set of options, and the names matter.

Hak Sewa is a lease, a contractual right to use land for an agreed period. It is what most Bali villa sales to foreigners actually are. It is registered by notarial deed, not as a land title, and when the term ends the land reverts to the Indonesian owner along with whatever is standing on it, unless a renewal was separately agreed and honoured.

Hak Guna Bangunan (HGB) is a right to build and own structures on land, granted for up to 30 years and extendable. HGB cannot be held by an individual foreigner. It is held by an Indonesian legal entity, which in practice means a PT PMA, a foreign investment company. If a villa is sold to a foreigner as HGB, the buyer needs to know which entity holds that title and what their relationship to it is.

Hak Pakai is a right of use that an individual foreign resident can hold, subject to residency and minimum value conditions.

A sales page that offers "Leasehold / HGB" as if they were interchangeable is describing two different sets of rights, obligations and exit outcomes. Asking which one appears on the deed, and in whose name, is a reasonable first question.

What Orbita states about itself

Orbita operates from Jl. Aster Raya No. 5, Pecatu, in Badung Regency, an address that appears on the company's own promotional pages, on its listing profiles at bali.realestate, and on a construction supervisor job advertisement placed under the name PT Orbita Real Estate. The company's Russian language site states it has operated in Indonesia since 2019 and is a tax resident there. A separate claim on the same site cites ten years of construction experience.

A commercial registry reseller lists "PT. Orbita Real Estate" in Badung at that address. That is a paid data aggregator rather than the Indonesian registry itself. Indonesia's OSS and AHU systems are not openly searchable, so the NIB, the incorporation date and the deed of establishment could not be confirmed against a primary source. The honest statement is that the entity name and address are consistent across several independent listings, and that the official registration particulars remain unverified in public sources.

Three co-founders are named, on the company's Russian language site and nowhere else that could be found: Mikhail Ermakov, Pavel Stolbnikov and Gleb Kryuchkov, each described as "сооснователь компании", co-founder of the company. No director or commissioner is named in any registry document that could be retrieved, and the English language site names nobody at all. For a buyer, that means the people who would sign a lease deed are not publicly identified.

The delivery record

Bektu's records list six Orbita projects on the Bukit, and the lease terms attached to them are not uniform. Villa Garuda in Jimbaran carries 25 years. A Dream apartment unit carries 29 years. The Dream Apartments club house carries 50. Green #1 and Green #2 in Melasti carry 80. These are villas and apartments marketed by one developer in one part of one island, with lease terms that differ by a factor of more than three.

That spread is not by itself evidence of anything improper. Lease terms in Bali depend on what the underlying landowner agreed to and on how much of the term the developer bought. It does mean that the "80 years" headline on the promotional page does not describe every product the company sells, and that a buyer needs the term for the specific unit, in writing, from the deed rather than from the brochure.

Stated completion dates also move depending on where you look. Bektu's record for Villa Garuda gives a completion date in August 2024 and a sales status of sold. The developer's profile on bali.realestate lists Villa Garuda with a third quarter 2023 delivery and still describes it as off plan. Dream View and Green units are listed on that profile with 2025 and 2026 quarters. No handover announcement, certificate of functional worthiness (SLF) or building approval (PBG) reference for any Orbita project could be located in public sources. Independent confirmation that any specific project was completed and handed over was not found.

The company's own site states that 250 villas are under management and that 9,620 square metres are currently under development, and markets returns of up to 13 percent a year on the promotional page. Those are developer figures. No audited financial statement, rental performance report or third party occupancy data supporting the yield figures was found.

Regulatory record

No Indonesian regulator action, zoning or *zona hijau* case, permit problem, court case or demolition order naming Orbita or PT Orbita Real Estate was found. That was searched for specifically, in Indonesian as well as English, including the Supreme Court decision directory at putusan.mahkamahagung.go.id and Bali property press.

That is a statement about what public records show, not a clearance. Bali enforcement actions are frequently reported only in local outlets or not at all, and the national business registries are not publicly searchable. Several sealing and demolition actions in Bali during 2025 and 2026 involved other developers entirely, among them a villa project in Ubud sealed for building on agricultural land and villas in the Pejarakan social forestry area in Buleleng that were demolished. None of those involve Orbita, and nothing in them should be read across to it.

No parent company, investor or financial backer could be identified. No contractor, architect, notary or management company is named in any source that could be read.

What to ask before buying

The questions that close the gaps above are short and specific. Which legal instrument is on the deed for this unit, Hak Sewa or HGB, and if HGB, which Indonesian entity holds the title. What is the initial term in years, as distinct from the marketed total. What exactly triggers each extension, who must consent, at what price, and what happens if the landowner refuses. Who are the named directors of the contracting entity, and does the notarial deed name them. Has this specific building received its PBG and SLF, and can copies be produced. A developer able to answer all six in writing has told you more than any brochure figure.
