Foreign Property Ownership in Portugal: The 2026 Rules

There are no foreign property ownership restrictions in Portugal. A non-resident, non-EU foreigner can buy an apartment in Lisbon, a villa in the Algarve, or a farmhouse in the Alentejo on exactly the same legal footing as a Portuguese citizen. There is no quota, no trust requirement, no leasehold-only rule, and no special approval. Portugal is one of the most open property markets in Europe for foreign buyers, and that openness is the starting point for understanding the regulations that do apply.

What trips people up is not a restriction on buying. It is two separate things: the tax registration you need before you can transact, and the fact that buying property no longer gives you a path to residency the way it once did.

What you actually need to buy

Before a foreigner can purchase property in Portugal, they need a Portuguese tax identification number, the número de identificação fiscal (NIF), issued by the tax authority, the Autoridade Tributária e Aduaneira. Non-EU residents typically appoint a fiscal representative to obtain the NIF. You will also need a Portuguese bank account to move funds and pay taxes, valid identification, and proof of the source of funds.

The purchase itself is formalized through a deed (escritura pública) before a notary, and the title is registered at the Land Registry (Conservatória do Registo Predial). Portugal also uses a promissory contract (contrato de promessa de compra e venda) before completion, under which the buyer usually pays a deposit of around 10 percent. If the buyer walks away, the deposit is forfeited. If the seller walks away, they generally owe double the deposit. That asymmetry is written into the Civil Code and is one of the few features of a Portuguese purchase that genuinely differs from common-law markets.
