Foreign Condominium Ownership in Thailand: The 49 Percent Quota Explained
A foreigner can own a condominium unit in Thailand outright, in freehold, with the title in their own name. A foreigner cannot own the land it sits on. That split is the foundation of every legitimate property purchase a foreign buyer makes in Phuket, Bangkok or Pattaya, and the rule that governs the condo side is the 49 percent foreign quota.
The legal basis is the Condominium Act B.E. 2522, passed in 1979 and amended several times since. It is the only statute that grants foreigners direct, registrable freehold ownership of real property in Thailand. The Land Code, by contrast, prohibits foreigners from owning land except in narrow, rarely used circumstances. So the practical question for a foreign buyer is not whether you can own a condo, you can, but whether the specific unit you want still falls inside the foreign quota.
What the 49 percent actually measures
The quota is measured by floor area, not by number of units. Under the Condominium Act, foreigners may collectively own up to 49 percent of the total saleable floor area of a registered condominium building. The remaining 51 percent must be held by Thai nationals or Thai majority owned entities. People often misstate this as "49 percent of the units," which can mislead you, because a building can hit its foreign quota on floor area while units still appear available.
When the foreign freehold quota in a building is exhausted, you cannot register that unit in your name as freehold, full stop. The developer cannot create more foreign quota. This is why two identical units in the same tower can have different ownership status: one inside the freehold quota, one not.
